Terms of Service

IslandLeads.ai (“IslandLeads,” “we,” “us,” or “our”) is a software-as-a-service property intelligence platform built for real estate investors operating in the United States Virgin Islands (USVI). The Service is operated by Virgin Island Ventures Co. (VIVCO), a company based in St. Croix, US Virgin Islands.

These Terms of Service (the “Terms”) govern your access to and use of IslandLeads.ai, including the website, web application, and any related APIs, mobile interfaces, or downloadable content (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service you represent that you meet these requirements and that you are not barred from using the Service under the laws of any applicable jurisdiction.

To access most features you must create an account. You agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account.

You agree to notify us immediately at info@vivco.co of any unauthorized use of your account.

IslandLeads is offered on monthly and annual subscription plans. Fees are billed in advance on a recurring basis through our payment processor and are non-refundable except where required by law. By starting a subscription you authorize us to charge the payment method on file at the start of each billing period.

We may change pricing at any time. Pricing changes will not apply to your current billing period but will take effect at the next renewal, and we will give reasonable advance notice.

We may offer a free trial of paid features. Unless cancelled before the end of the trial, your account will automatically convert to a paid subscription at the then-current rate for the plan you selected. You can cancel at any time from the Billing settings page.

You agree not to:

• Use the Service to harass property owners or send unsolicited bulk communications;
• Scrape, resell, sublicense, or redistribute data obtained from the Service;
• Reverse engineer, decompile, or attempt to extract source code from the Service;
• Use the Service to violate any applicable USVI, federal, or local law;
• Interfere with the Service’s operation or attempt to gain unauthorized access.

We may suspend or terminate accounts that violate this section, with or without notice.

IslandLeads aggregates information from public records, third-party data providers, and algorithmic scoring. We make commercially reasonable efforts to keep the data accurate but do not warrant that any property record, tax status, ownership detail, distress score, or valuation is complete, current, or error-free. You are solely responsible for independently verifying any information before relying on it for an investment decision.

Information about the USVI Economic Development Commission (EDC), Small Sub-Tropical Zone (SSTZ), Enterprise Zone Commission (EZC), and similar tax incentive programs is provided for general informational purposes only. Eligibility for any incentive is determined exclusively by the relevant USVI authority. Nothing in the Service constitutes legal, tax, or financial advice, and you should consult qualified professionals before making any decision based on incentive eligibility indicators shown in the Service.

The attorney directory is provided as a convenience. Listings do not constitute an endorsement, recommendation, or referral. We do not guarantee the qualifications, availability, fees, or results of any listed attorney. Your engagement with any attorney is solely between you and that attorney.

Portions of the Service generate text using artificial intelligence, including outreach letters, owner-finance term sheets, and offer summaries. AI-generated content may contain errors, omissions, or inaccuracies. You are responsible for reviewing all AI-generated content before sending it to any third party or relying on it. Do not send AI-generated communications that could mislead a recipient about a material fact.

The Service, including its software, design, branding, scoring algorithms, and aggregated data presentations, is owned by VIVCO and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal investment purposes during your active subscription.

You retain ownership of the content you enter into the Service, including pipeline notes, contacts, and uploaded files (“User Data”). You grant us a worldwide, royalty-free license to host, process, and display your User Data solely as necessary to provide the Service. Our handling of personal information is governed by our Privacy Policy.

To the maximum extent permitted by law, IslandLeads and VIVCO are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless VIVCO, IslandLeads, and our officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your User Data, or your violation of these Terms or any applicable law.

You may cancel your subscription at any time from the Billing settings page. We may suspend or terminate your access for any violation of these Terms or for any reason with notice. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will survive.

We may update these Terms from time to time. If we make material changes we will notify you by email or by an in-app notice before the changes take effect. Continued use of the Service after the effective date of revised Terms constitutes acceptance.

These Terms are governed by the laws of the United States Virgin Islands, without regard to conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the courts located in St. Croix, US Virgin Islands, for any dispute arising out of or relating to these Terms or the Service.
